Ebeco Connect license terms and agreement
In using the software, you confirm that you have read and understood this agreement and agree to comply with its terms and conditions. If you do not agree, you may not use the software and you must uninstall the software from all devices that you own or control.
1. Licence
A licence agreement for end users has been entered into between Ebeco AB or its group company and you as end user. In approving this agreement, Ebeco gives you a limited, non-exclusive, non-transferable, royalty-free, purely for personal, non-commercial purposes, global licence that gives you the right to install and use the software that is stored in your EB-Therm 500 with EB-Connect WiFi. The licence is granted on condition that the user complies with the terms and conditions of this agreement. This agreement does not regulate the purchase of the product.
2. Ownership right
The licence and application contain protected information that is owned by Ebeco and which is protected by current intellectual property law. Other than what is explicitly allowed in this agreement, information owned by Ebeco may not
- a) be copied or reproduced in any form, or
- b) be modified, rented out, leased, sold, distributed or utilised commercially.
Ebeco reserves the right to change, withdraw, remove or inactivate the user's access without prior notice at any time. The name Ebeco, the Ebeco logo, other Ebeco brands, Ebeco logos and other Ebeco graphics are trademarks or registered trademarks that belong to Ebeco or its group companies. The user is not granted any right or licence for such trademarks.
3.Consent for the use of data
In allowing your EB-Therm 500 with EB-Connect WiFi to connect wirelessly to the internet, you agree that Ebeco may collect, use, register and store information about your property name, room/unit name, operating condition, temperature values, IP addresses, programme and hardware attributes, connection errors and your user interaction. Such information is used by Ebeco to improve factory settings and software performance.
4. Changes in software
Ebeco may develop corrections, bug fixes, updates and other modifications to improve software performance. In connecting EB-Therm 500 with EB-Connect WiFi to the internet, you agree that updates can be automatically downloaded and installed on your EB-Therm 500 with EB-Connect WiFi without prior warning and with no need for consent. You understand that you may need to install updates to be able to use the product for remote access.
5. Disclaimer
The licence is provided only on the basis of "in existing condition" and "according to availability" for the intended purposes determined by Ebeco, and all use occurs at the user's own risk. The software as well as results and information produced thereof cannot replace technical advice, but must be verified by the user. It does not represent any promise and should not be understood as precise data or analysis. Ebeco disclaims all guarantees and conditions regarding the software, whether expressed, implied or statutory, including but not limited to, conditions for marketability, satisfactory quality, suitability for a particular purpose, accuracy and non-intrusion into third-party rights. Ebeco does not guarantee that the software meets your needs or that the use of it is uninterrupted or faultless.
6. Third-party components
The software may contain certain third-party software components, including open source and free software components, all of which have their own copyright and their own licence terms. To the extent that a third-party licence gives the user the rights to use, copy or modify the open source component that cover more or less than the rights granted in this agreement, such rights shall take precedence over the rights and restrictions granted in this agreement only for such third-party components.
7. Limitation of liability
To the extent not prohibited by law, Ebeco shall under no circumstances be held liable for direct, specific or indirect damage or consequential damage, including but not limited to material damage, or be liable for damages due to the loss of savings, profits or data as a result of the use of the application.
8. Termination
The licence shall automatically cease if the user violates any of the terms of this agreement. Ebeco can terminate the license at its discretion without prior notice. The agreement and the license are subject to material law in Sweden. Disputes arising from or in connection with this agreement shall be submitted to the exclusive jurisdiction of the courts of Sweden.
